国際教養AO入試 , SILS, The Jury in America - rewrite -

The institution of the jury may be aristocratic or democratic, according to the class form which the jurors are taken; but it always preserves its republican character, in that it places the real direction of society in the hands of the governed, and not in that of the government.. In the United States the same system is applied to the whole people. The jury system as it is understood in America appears to me to be as extreme a consequence of the sovereignty of the people as the universal right to vote. When the jury acts also on non-criminal cases, its application is constantly visible; it affects all the interests of the community; everyone co-operates in its work: it thus penetrates into all the activities of life, it fashions the human mind to its peculiar forms, and it is gradually associated with the idea of justice itself.

He who punishes the criminal is therefore the real master of society. Now, the institution of the jury raises the people itself, or at least a class of citizens, to the bench of judges.
When the jury acts also on non-criminal cases, its application is constantly visible; it affects all the interests of the community; everyone co-operates in its work: it thus penetrates into all the activities of life, it fashions the human mind to its peculiar forms, and it is gradually associated with the idea of justice itself.
The institution of the jury, if limited to criminal cases, is always in danger; but when once it is introduced into non-criminal proceedings, it defies the aggressions of time and man. If it had been as easy to remove the jury from the customs as from the laws of England, it would have died away under the Tudor monarchs; and the non-criminal jury did in reality in the period of history save the liberties of England.
In whatever manner the jury may be used, it cannot fail to exercise a powerful influence upon the national character; but this influence is greatly increased when the jury is used in non-criminal cases.
The jury, and especially the non-criminal jury, saves to introduce the spirit of the judges into the minds of all of the citizens; and this spirit; and this spirit, with all of the habits which are associated with that spirit, is the soundest preparation for free institutions.
The jury gives all classes a respect for the thing judges and the concept of human rights. If these two elements were to be removed, the love of independence would become a mere destructive passion. It teaches It teaches men to practice fairness; every man learns to judge his neighbor as he would himself be judged. And this is especially true of the jury in non-criminal cases; for while the number of persons who have the chance of being involved in ca criminal prosecution is small, everyone has the chance of being involved in a non-criminal case.
The jury teaches every man not to reject the responsibility of his own actions and impresses him with that manly confidence towards society and the part which they take in its government.
It invests each citizen with a kind of supremacy; it makes them all feel the duties which they are bound to discharge towards society and the part which they take in its government.
By obliging men to turn their attention to other affairs than their own, it rubs off the private selfishness which is the rust of society.

Many citizens are so apathetic to social issues that in non-criminal cases intensive preparation for the court, especially education of the jury in related matters, may be necessary.
☆Since Japanese democracy is not deep-rooted but is just regarded as the regime which was replaced with the imperialism after WWII, many of the selected as jury might not have thought or never have the will to think about fairness. responsibility as a citizen or influence on the Japanese society and its future and thus could make a wrong verdict,
☆Democracy, decision-making by majority voting, is not always right. Classes, racial or ethnic prejudices might easily affect the verdict depending on the proportion of members whose thoughts are potentially affected by such factors in the jury . There is a report that a jury whose members are predominantly white tend to sentence a black defendant to death more often than a less- white jury in the US. In Japan, where foreign residents are extreme minorities and there are deep-rooted discriminations against Korean residents, for example, the accused who is a Korean resident is doomed to lose the case and the whole process will be tremendously affected by how many members can think and act impartially in the jury.
☆Only those who will sign the form that he can take responsibility in case of death sentence will be in the jury of murder cases, and thus jury of murder cases consists of only those who are at least not against death penalty. This is a serious flaw in the system. Japan has not abolished death sentence and the rates of objection against abolition is very high, so execution rates may go up and unnecessary tragedy may increase. There already are Japanese people who voted for death sentence and realize the cruelty and blame themselves later.
☆In the case of the security-related law suit, for which some lawyers are preparing for, since nearly 70 percent of the Japanese think it unconstitutional and the way Abe administration passed the law was that of undemocratic, the jury would make a decision problematic to the authorities, although it is not actually a problem to the citizens.

TOEFL, iBT, Independent Writing, One important change in the government of your country you would like to make - rewrite -

Writing Topic
Suppose you had the power to make one important change in the government of your country. What change would you like to make, and why?

☆Hints for Points
1       money politics (“seiji to kane” no mondai): Corrupted politicians receive money from interest groups (big businesses) in return for doing favor for them, which in turn support them in elections. They have weakened Japanese economy mainly by allocating large part of the budget for building unnecessary airports, bridges, roads, and other facilities whose construction even the local people question for decades. Anti-corruption laws have been enacted but there have always been loopholes and this problem never ends. Part of the problem is that those who make these laws are the very people who are regulated by them, politicians. Also, whistle-blowing will cost one’s job. To establish a committee which is totally independent from the public sector and which makes original budget plans and has authority to intervene government spending might be an idea to solve the problem.

2       absence of accountability: Since the Great East Japan Earthquake, it has become clearer that no one in the cabinet can take a real initiative and responsibility, while everyone trying hard to hide information from the public. Group-orientation and custom of dodging responsibilities is the foundation of the Japanese system and therefore it is not likely to change easily.

3       decentralization (chihoubunken): Japan is a highly centralized state where government bureaucrats take the initiative. While this practice might be generally suitable for this small country, the drawback is less freedom in local governments and political apathy. The government should partly shift authority in some areas such as education, welfare, and development

4       revitalization of the disaster-stricken areas: People in Tohoku hit by the Great East Japan Earthquake and the Tsunami have been suffering since then. We have to think of some viable measures to support their life in dignity and independence.

5       accepting immigrants: Japan is infamous about not active about accepting immigrants. As a wealthy country, it should join other developed countries to let immigrants into the country and help them pursue a better life.

6       disarmament: As the only country who has experienced being bombed with atomic weapons, Japan should be more assertive in disarmament. When most of the people who actually experienced the attack and the aftermath are over 70 years old and many are passing away year by year, we should more consciously try to pass down the memory of the history to the next generation and keep requesting to the world peace and arm-free, diplomatic relations between countries.

7       the gap between the rich and (the) poor: Wealth gap has been getting bigger in Japan, which has been famous as a relatively equal society over the past several decades. It has been proved that income inequality causes many kinds of problems. Therefore, the government should work on the problem more seriously.

8       free education and medicine: This will help greatly the disadvantaged and the country, which will lead to vitalized economy and stabilized society.

9       sharing the rights to use Takeshima and Senkaku Islands with other countries that insist their rights to possess them. This will soften the tension between involved countries and enrich all. (People’s Peace  Johan Galtung)

国際教養AO入試 , SILS, The Climax of Humanity - rewrite -

a. price tag=value, hang a price tag=evaluate (calculate) the value, nature’s benefits=products and services that nature provides for humansなどと置き換えられるので、例えば、The recent approach described in the passage is to make assessment of the value of the products and services that nature provides for humans.

These three concurrent, intertwined transitions―demographic, economic, environmental―are what historians of the future will remember when they look back on our age. In recent years, economists and environmental scientists have come together to hang a price tag on nature’s benefits. When the environment is properly accounted for, what is good for nature is often what is good for the economy and even for individual business sectors. If decisions makers can get the framework right, the future of humanity will be secured by thousands of mundane decisions:  how many babies people have, where they graze their cattle, how they insulate their houses.

a. False
More broadly, the prices we pay for goods and services seldom include the associated environmental costs.
False
True
After several centuries of faster-than-exponential growth, the world’s population is stabilizing. Judging from current trends, it will plateau at around nine billion people toward the middle of this century.

More broadly, the prices we pay for goods and services seldom include the associated environmental costs. In recent years, economists and environmental scientists have come together to hang a price tag on nature’s benefits.
The approach assesses environmental costs that is not included in current prices by calculating damage that nature will have through economic activities such as resource depletion, environmental destruction, and global warming. /, the substantial value of nature and true price of goods can be learned.
The distorted market gives consumers and producers little incentive to clean up. Far from demeaning nature, this exercise reveals how much we depend on it. When the environment is properly accounted for, what is good for nature is often what is good for the economy and even for individual business sectors.
This approach will tell us the value of nature in economy and helps realize a sustainable economy. For example, if commodity prices include costs to pay for or to prevent collateral loss of environmental assets, consumers will avoid items with high environmental costs and the manufacturers will be forced to come up with ways to make their manufacturing system more sustainable. Also, the money paid for the environment can be used to make up for the damage and produce goods with less stress on the environment. For example, this system could deal with environmental costs such as contaminated waters caused by oil well development, famine caused by global warming, or increase of the number of cancer patients caused by the use of fertilizers and insecticides or radioactive waste disposal. It can protect nature and our lives as well as decreasing extreme poverty caused by environmental destruction (global warming, destruction of ecosystem, pollution, etc.) Therefore, it is good for the future of humankind and economy in the end.
The ecosystem is so complicated that it is difficult to estimate its economic value. If you wanted to make a precise calculation, you would have to count the number of all the species in it and investigate the relationships of these species such as food chain and symbiosis, and then simulate and quantify the character and degree of damage it would incur in case of its destruction. However, it would be almost impossible to do this with an ecosystem such as the Amazon tropical rainforest, which is vast, is full of unknown factors, and keeps changing. Therefore, patience and very careful research and assessment would be required in practicing such an approach.

☆Extra Questions
1) To meet the needs of the extremely poor, we need only less than ( ) % of income of the rich world.
Answer: one
2) Why are the issues of the poor the issues of women?
Answer: a. Most of the poor, the illiterate, and HIV/AIDS patients are women. Therefore, helping poor women will directly reduce the number of the poor. b. TOEFL, iBT, Independent Writing, Automobiles have improved the quality of our lives. - rewrite -

Writing Topic
Consider the following statement. Automobiles have improved the quality of our lives. Do you agree or disagree with this idea? Support your response by including specific reasons and examples.

☆Let’s think
It is recommended that you think of points for both agreement and disagreement with the statement of the writing topic in brainstorming and then decide whether you agree or disagree. In the case of the car, both of its positive and negative impacts on society can be come up with. Your conclusion sentence might include expressions like “cannot totally agree with…” or “I agree with … except that …”

☆Note
The writing topic statement says “have improved”, not “improves”. Thus it is asking about the past and present. Thus a conclusion as follows cannot be considered the answer that accurately deals with the writing topic: I believe automobiles contribute to our lives because it improves our lives. This sentence is talking about the property of the automobile that applies to any time, while the writing topic asks about the change it has caused.

☆Ideas and Expressions
For the statement:
1)  Automobiles have increased mobility of society. People can commute, travel, or be transferred to places far away from home.

2)  Businesses have expanded thanks to cars. We have come to be able to trade between places which were too far away to do it before cars were invented.

3)  Cars have offered us more opportunities. In the old times, for instance, social life was limited within walking distance or within the areas that you can reach on horseback, in other words, within the village or the city the person lives, but life with automobiles enables one to venture to go beyond the town border to meet new people.

4)  Cars have given birth to the assembly line, which made possible to provide large numbers of items at low prices.

Against the statement:
